第2 條 ：中華民國 (流亡中)承認1952年4月28日-舊金山和平條約SFPT的有效性。
Article 2"It is recognized that under Article 2 of the Treaty of Peace with Japan signed at the city of San Francisco in the United States of America on September 8, 1951 (hereinafter referred to as the San Francisco Treaty), Japan has renounced all right, title and claim to Taiwan (Formosa) and Penghu (the Pescadores) as well as the Spratly Islands and the Paracel Islands."

第10條 ：為了夲條約的成立，中華民國 ( 流亡中 ) 將 【臺澎住民 The Inhabitants of Taiwan and Penghu 】視如 ( shall be deemed to )中華民國國民。 (因為有這個前提條件，合約才成立) ； 1952 年 4 月 28 日 - 日華台北和約 Taipei Treaty 簽約的當時約有 610 萬【臺澎住民 The Inhabitants of Taiwan and Penghu 】。

從此，台灣人喪失日本國籍， 而 法理上 亦 非 中華民國國籍 ， 淪為2009年4月7日美國聯邦上訴法院之判決文(案號08-5078):「64年來，本土台灣人無國籍，台灣人無國際社會承認之政府，至今仍生活在政治煉獄中」所陳述之事實
Article 10"For the purposes of the present Treaty, nationals of the Republic of China, shall be deemed to include all the inhabitants and former inhabitants of Taiwan (Formosa) and Penghu (the Pescadores) and their descendents who are of the Chinese nationality in accordance with the laws and regulations…

3) 1979年1月1日美國台灣關係法( AIT 美國在台協會網站)
1979 年台灣關係法 TRA 明文標示：台灣不是中華民國，中華民國不是臺灣，第十五條：「臺灣」一詞將視情況需要，包括臺灣及澎湖列島，這些島上的人民、公司及根據適用於這些島嶼的法律而設立或組成的其他團體及機構， 1979 年1月1 日以前美國承認為中華民國的臺灣治理當局、 以及任何接替的島上治理當局 （
括政治分支機構、機構等） ；

4) 1982年7月14日 雷根總統六項保證：「一、美國無意就對台軍售設下截止日期；二、美國不會就對台軍售議題事先與中華人民共和國諮商；三、美國不會在中華人民共和國壓力下停止對台軍售；四、美國不會修改台灣關係法；五、美國無意扮演台海兩岸的仲介者，美國不能施壓迫使台灣與中華人民共和國展開談判；六、美國不支持中華人民共和國對台灣主權的主張。」
5) 04-03-2014美國國務院助理國務卿羅素（Daniel Russel）東亞暨亞太事務助卿羅素 在參議院外交委員會作證時，提到Strong United States support for Taiwan autonomy (美國對台灣自治自主（autonomy）的強烈支持) 美國國務院官網原文：http://www.state.gov/p/eap/rls/rm/2014/04/224350.htm可以證明被佔領地的台灣人民確有【自治權】無誤。
